Please read the following terms and conditions carefully. These terms govern your use of our website and the purchase of our products and services.
1. General
The following conditions apply to all transactions with our company. Deviating agreements require our written confirmation; they have no retroactive effect on previous deliveries nor do they apply to subsequent transactions. Purchasing conditions of our clients are only recognized by us if they do not contradict our conditions.
2. Prices
Our prices are ex works. The calculation is based on the prices valid at the time of delivery.
- For orders with a net goods value of at least €1,000.00, delivery within the Federal Republic of Germany is freight-free to destination.
- For small orders under a net goods value of €50.00, a processing fee of €5.00 plus shipping costs will be charged.
Verbal agreements are only valid if confirmed by us in writing.
3. Delivery Dates
Agreed delivery times are adhered to as far as possible and are approximate.
Delays in deliveries do not entitle cancellation of orders or the assertion of other claims.
Events of force majeure release us from the obligation to deliver.
4. Terms of Payment
Invoices are payable within 14 days with 2% discount or within 30 days net, regardless of the receipt of goods and the right of complaint.
In advance, we grant 3% discount.
In the event of delayed payment, we reserve the right to withhold further deliveries, require advance payment, withdraw from the contract or claim damages for non-performance.
We are entitled to charge default interest at the applicable bank interest rate.
Payments are to be made directly to us.
Representatives are only authorized to collect payments upon presentation of written authorization.
5. Retention of Title
All goods delivered remain our property until full payment has been received.
The buyer accepts our extended retention of title, including co-ownership in further processing.
In the event of payment default, we reserve the right to reclaim goods up to the amount of our outstanding claim, including incurred costs and default interest.
6. Complaints
Complaints of any kind must be submitted within 8 days of receipt of goods.
Defects demonstrably caused by material or manufacturing faults will be corrected free of charge.
We are not liable for compensation claims, wages, penalties, or damages unrelated to the delivered goods themselves.
6a. Inspection of Rejected Goods
(1) Goods subject to a complaint must be sent to us following prior consultation. We examine each item subject to a complaint individually and inform the client of the inspection result.
(2) If the inspection reveals that there is no defect for which we are responsible, and the client could have recognized this upon reasonable inspection, the client shall reimburse us for the inspection and processing costs. This is charged at a flat rate of 52 euros (net) per inspection process, plus the shipping costs actually incurred.
(3) The client reserves the right to prove that no costs were incurred or that the costs incurred were significantly lower. We reserve the right to prove that higher costs were incurred.
(4) The flat-rate charge shall not apply if the inspection confirms a defect for which we are responsible, if we are responsible for an incorrect delivery or an over-delivery, or if the client could not have recognized the cause of the complaint even upon reasonable inspection.
7. Liability for Delivery Defects
Faulty parts resulting from defective design, materials, or workmanship will be repaired or replaced free of charge at our discretion within 24 months of installation.
Defects must be reported immediately in writing.
Replaced parts become our property.
If shipment or installation is delayed without our fault, liability expires after 30 months.
8. Returns
Returns, except for defective goods covered under Section 7, and order cancellations require our express written approval.
For returns of faultless goods, a handling fee of 25% of the net goods value will be charged.
